Terms & Conditions

By downloading, installing, or using the CookBy mobile application or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

CookBy is operated by Sixmend Technologies ("Company", "we", "our", "us"), registered in Kerala, India.

CookBy is a meal subscription platform that connects customers with mess kitchens (local meal providers). The Service includes:

• CookBy Customer App — for customers to subscribe to a mess, view menus, manage meals, and pay bills
• CookBy Mess Owner App — for kitchen managers to manage menus, track meal counts, and manage subscribers
• Backend services — automated order creation, billing, and notifications

• You must provide a valid Indian mobile phone number to create an account.
• You are responsible for maintaining the confidentiality of your account and for all activities under your account.
• You must provide accurate and complete information during registration.
• You must be at least 13 years of age to use the Service.
• One phone number may only be associated with one customer account.

• A subscription links you to a specific mess kitchen for selected meal slots (Breakfast, Lunch, Dinner) on selected days of the week.
• You may subscribe to only one mess at a time.
• Meal orders are automatically created daily based on your subscription. You are responsible for cancelling meals you do not wish to receive.
• Cancellations must be made before the mess's cutoff time for that meal slot. The cutoff time is set by the mess owner.
• Meal menus are set by the mess owner and may change without prior notice.

• You may cancel specific meals on specific dates through the app.
• Cancelled meals are not billed. Only meals actually served are included in your monthly bill.
• You may undo a cancellation before the cutoff time.
• The Company is not responsible for meals missed due to failure to cancel in time.

• Bills are generated monthly based on the number of meals served (total subscription days minus cancelled meals).
• Bill amount = days served × price per meal slot.
• All payments are made directly between you and your mess owner. CookBy does not process, collect, or handle any payments or money.
• The platform displays billing summaries for reference only. Actual payment settlement is between you and the mess owner.
• All prices shown are in Indian Rupees (INR).
• Failure to settle bills with your mess owner may result in suspension of your subscription at their discretion.

If you are a mess owner using the CookBy Mess Owner App:

• You are responsible for the quality, safety, and hygiene of food served to subscribers.
• You must maintain accurate menus and pricing on the platform.
• You must comply with all applicable food safety regulations (FSSAI) and local laws.
• CookBy is a technology platform — we do not prepare, handle, or deliver food.

You agree not to:

• Use the Service for any unlawful purpose
• Create multiple accounts with the same phone number
• Impersonate another person or entity
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Use automated means to access the Service without our permission

The CookBy name, logo, app design, and all related content are the property of Sixmend Technologies. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.

• CookBy is a technology platform connecting customers with mess kitchens. We are not responsible for the quality, taste, or safety of food prepared by mess owners.
• We are not liable for any disputes between customers and mess owners regarding food quality, service, or payments made outside the platform.
• The Service is provided "as is" without warranties of any kind, either express or implied.
• Our total liability shall not exceed the amount you paid through the platform in the preceding 3 months.

• You may delete your account at any time through our account deletion page.
• We may suspend or terminate your account if you violate these terms.
• Upon account deletion, all your personal data will be permanently removed.
• Outstanding bills must be settled before or at the time of account deletion.

We reserve the right to modify these Terms at any time. Changes will be effective when posted with an updated "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the new terms.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Kottayam, Kerala, India.
